Recently, plaintiff “Harry Potter” argued before the High Court of Delhi that the film “Hari Puttar” was visually and phonetically similar to its registered TM. The Court ruled in favor of Defendant based not on similarity of the marks but on the targeted audience. What are your thoughts?
